TERMS OF SERVICE

These Terms of Service, together with any policies, notices, product descriptions, checkout terms, and other documents referenced in these Terms, govern your access to and use of the websites, online courses, digital training resources, learning platforms, software features, communities, discussion areas, account portals, physical goods, and related products and services offered by Level Flight Inc.
In these Terms, “Level Flight,” “we,” “us,” and “our” refer to Level Flight Inc. “You” and “your” refer to any person who accesses or uses our Site, creates an account, purchases a product or service, participates in a course, or otherwise uses our materials.
By accessing our Site, creating an account, purchasing a product or service, or using any Level Flight materials, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use our Site, products, services, courses, software, physical goods, digital products, or materials.
1. Our Site, Products, and Services
Level Flight provides aviation education resources, e-learning courses, digital training resources, exam preparation tools, software-supported learning tools, physical goods, promotional products, and related services.
Our products and services may include, but are not limited to:
- Ground school courses;
- Exam preparation products;
- Adaptive learning tools;
- Digital training resources;
- Downloadable or printable educational materials;
- Video, audio, written, and interactive course content;
- Community features, discussion groups, messaging, or support areas;
- Printed or physical learning materials;
- Training aids;
- Apparel;
- Merchandise;
- Promotional products; and
- Other aviation education resources.
Some products or services may be offered directly by Level Flight, while others may be made available through third-party platforms, payment processors, learning management systems, partner flight schools, suppliers, shipping carriers, or other service providers.
2. Educational Purpose and Aviation Disclaimer
Level Flight materials are provided for educational and training support purposes only. Our courses, exam preparation tools, explanations, videos, questions, summaries, and other materials are intended to assist students in learning aviation concepts and preparing for training or examinations.
Level Flight materials are not a substitute for:
- The Canadian Aviation Regulations;
- The Transport Canada Aeronautical Information Manual;
- Transport Canada publications, standards, circulars, or guidance;
- Official examination guides or licensing requirements;
- Approved flight training unit instruction;
- Aircraft flight manuals, pilot operating handbooks, standard operating procedures, or company manuals;
- Instructor guidance;
- Professional judgment; or
- Operational decision-making.
Aviation rules, procedures, guidance, examination standards, and industry practices may change. While we make reasonable efforts to keep our materials accurate and current, we do not guarantee that all content is complete, current, error-free, or suitable for every training situation, examination, aircraft, jurisdiction, or operational context.
You are responsible for verifying important information against official and current sources before relying on it for training, examinations, flight planning, flight operations, licensing, or any safety-related decision.
3. Eligibility and Minors
You may only use our Site, products, services, and accounts if you have the legal capacity to enter into these Terms or if you are using them with the consent and supervision of a parent, guardian, or other legally authorized person.
If you are under the age of majority in your province or territory, your parent or guardian must agree to these Terms on your behalf. A parent or guardian who permits a minor to use our Site, products, services, or account features is responsible for that minor’s use.
4. Accounts
To access some products or services, you may be required to create an account.
When you create or use an account, you agree that:
- The information you provide will be accurate, complete, and current;
- You will keep your login credentials secure and confidential;
- You are responsible for all activity that occurs under your account;
- You will not share, sell, lend, transfer, or otherwise provide your account access to any other person unless expressly authorized by Level Flight in writing;
- You will not use another person’s account without authorization;
- You will notify us promptly if you believe your account has been compromised or used without authorization; and
- You will update your account information if it changes.
Accounts are intended for the registered user only. Unless we have expressly agreed otherwise in writing, a purchase of an individual course, exam prep product, subscription, digital resource, or software-supported learning tool grants access to one individual user only.
5. Account Sharing and Unauthorized Access
Account sharing is strictly prohibited.
You must not:
- Share your username, password, login link, access code, session, or account credentials with another person;
- Permit another person to access or use your account;
- Use your account to train, tutor, coach, or provide access to other students unless expressly authorized by Level Flight;
- Purchase one user account for use by multiple people;
- Circumvent access controls, user limits, licence restrictions, device limits, time limits, or other technical protections;
- Use another person’s account or login credentials;
- Resell, rent, sublicense, transfer, or commercially exploit your access;
- Create multiple accounts to avoid limits, restrictions, suspension, termination, fees, or other enforcement measures; or
- Assist any person in doing any of the above.
We may use reasonable technical, administrative, and usage-based measures to detect, prevent, and investigate account sharing, unauthorized access, abuse, or suspicious activity. These may include review of login patterns, IP addresses, device information, access frequency, concurrent sessions, account behaviour, course progress anomalies, and other security or usage signals.
If we believe that account sharing, unauthorized access, misuse, or a breach of these Terms has occurred, we may, without limiting our other rights:
- Require a password reset;
- Limit access;
- Suspend or terminate the account;
- Disable access to courses or resources;
- Refuse future purchases;
- Revoke certificates, completion records, recommendations, or other course-related documents if they were obtained through improper use;
- Require payment for additional users or licences;
- Decline a refund; and/or
- Take legal action where appropriate.
6. Licence to Use Digital Products and Course Materials
Subject to your compliance with these Terms and payment of all applicable fees, Level Flight grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the purchased course, digital product, software feature, or training resource for your own personal educational use or, where expressly agreed, for authorized internal training use.
Unless otherwise stated in writing, this licence does not give you ownership of any course content, software, questions, explanations, videos, diagrams, documents, downloadable files, methods, lesson structure, platform functionality, branding, or intellectual property.
You must not copy, reproduce, distribute, publish, upload, transmit, display, sell, resell, sublicense, rent, lend, modify, adapt, translate, scrape, data-mine, reverse engineer, decompile, create derivative works from, or otherwise exploit Level Flight materials except as expressly permitted by these Terms or by written permission from Level Flight.
7. Intellectual Property
All content, materials, and intellectual property made available by Level Flight are owned by Level Flight Inc., its licensors, or its content creators, as applicable.
This includes, but is not limited to:
- Course videos;
- Audio recordings;
- Written lessons;
- Question banks;
- Practice exams;
- Explanations and rationales;
- Adaptive learning methods;
- Software features;
- Quizzes and assessments;
- Diagrams and images;
- Documents and downloadable files;
- Slide decks;
- Logos and branding;
- Page layouts and course structure;
- Learning pathways;
- Study plans;
- Summaries;
- Community prompts;
- Templates;
- Certificates;
- Marketing content; and
- Anything else that contributes to the Site, courses, products, software, or services.
You acknowledge that Level Flight materials are protected by copyright, trademark, trade secret, and other intellectual property laws.
You must not remove, obscure, alter, or tamper with any copyright notice, trademark, watermark, attribution, rights management information, access control, or technological protection measure associated with Level Flight materials.
8. Prohibited Copying, Distribution, and Misuse of Materials
You must not, without our prior written consent:
- Share Level Flight course materials with another person;
- Post Level Flight materials online;
- Upload Level Flight materials to social media, file-sharing sites, AI tools, learning platforms, cloud drives, forums, or group chats;
- Record, screen-record, photograph, screenshot, download, copy, print, or extract materials except where the platform expressly allows it for your personal study use;
- Recreate or compile Level Flight question banks, explanations, lessons, diagrams, or course structures;
- Use Level Flight materials to create a competing product, course, question bank, tutoring service, exam preparation tool, software product, or training resource;
- Use bots, crawlers, scrapers, browser extensions, automation, or data extraction tools to access or collect Level Flight materials;
- Circumvent or attempt to circumvent access controls, watermarks, device restrictions, copy protections, download restrictions, or other technical safeguards;
- Sell, resell, rent, lend, license, sublicense, transfer, or otherwise commercially exploit Level Flight materials;
- Use Level Flight content to train, fine-tune, prompt, benchmark, or populate artificial intelligence systems, machine learning models, databases, or automated content tools; or
- Help another person do any of the above.
Any unauthorized copying, sharing, distribution, resale, account sharing, scraping, or misuse of Level Flight materials may result in account termination, refusal of refund, loss of access, legal action, and any other remedy available to us.
9. Flight School, Group, and Partnership Access
Some users may access Level Flight products or services through a flight school, employer, partner organization, group licence, coupon code, bulk purchase, student portal, or other partnership arrangement.
Unless otherwise agreed in writing:
Each account is for one individual user only;
- Access may not be shared among multiple students, staff members, instructors, or organizations;
- Group access is limited to the number of users, seats, time period, products, and purposes authorized by Level Flight;
- The organization is responsible for ensuring that its users comply with these Terms;
- Level Flight may suspend or terminate access if a partner, organization, administrator, or user breaches these Terms; and
- Refunds for courses purchased through flight school partnerships are subject to the refund terms below unless a separate written agreement says otherwise.
10. Acceptable Use
You agree to use our Site, products, services, community areas, software, and materials lawfully and respectfully.
You must not:
- Use our Site or services for any unlawful, fraudulent, harmful, abusive, or misleading purpose;
- Harass, threaten, abuse, defame, intimidate, or mistreat any person;
- Violate the rights, privacy, or intellectual property rights of Level Flight, other users, or any third party;
- Attempt to gain unauthorized access to accounts, systems, data, networks, or software;
- Introduce viruses, malware, harmful code, or disruptive technology;
- Interfere with the security, availability, performance, or integrity of our Site, platform, courses, or services;
- Use automated tools, bots, scrapers, or other systems to access, copy, test, scrape, overload, or interfere with our Site or services;
- Impersonate another person or misrepresent your identity, affiliation, training status, qualifications, or authority;
- Post or transmit content that is inappropriate, offensive, discriminatory, hateful, sexually explicit, violent, misleading, defamatory, infringing, or otherwise objectionable;
- Attempt to manipulate course progress, quiz results, exam prep outcomes, certificates, recommendations, or completion records;
- Use Level Flight materials in a way that could compromise examination integrity; or
- Encourage, assist, or enable another person to violate these Terms.
If we believe you are using our Site, products, services, software, community areas, or materials in a way that violates these Terms, applicable law, or the rights of Level Flight or another person, we may limit, suspend, or terminate your access and take any legal or technical steps we consider appropriate.
11. User Contributions and Community Features
Our Site or related platforms may allow users to post or submit comments, discussion posts, messages, questions, answers, feedback, reviews, assignments, files, or other content.
By submitting user content, you confirm that:
- You have the right to submit it;
- It does not violate the rights of any other person;
- It does not contain confidential, private, infringing, unlawful, or inappropriate material;
- It is accurate to the best of your knowledge where accuracy matters; and
- It complies with these Terms.
You retain ownership of content you submit, but you grant Level Flight a worldwide, non-exclusive, royalty-free licence to use, host, store, reproduce, display, moderate, remove, adapt, and process that content for the purposes of operating, improving, supporting, and promoting our Site, products, services, and learning community.
We may remove, edit, restrict, or refuse user content at any time if we believe it violates these Terms, creates risk, infringes rights, is inappropriate, or is otherwise unsuitable.
We are not responsible for user-generated content posted by other users.
12. Feedback and Suggestions
If you provide ideas, suggestions, corrections, comments, feature requests, testimonials, or other feedback about Level Flight, our Site, courses, materials, products, or services, you agree that we may use that feedback without restriction or compensation to you.
This does not require us to use your feedback, identify you, or treat the feedback as confidential unless we separately agree in writing.
13. Sale of Goods and Services
These Terms govern the sale of goods, digital products, e-learning services, software-supported learning tools, and other products or services made available by Level Flight through our Site, checkout pages, partner portals, or other approved sales channels.
Goods
The goods available through Level Flight may include, but are not limited to:
- Educational resources;
- Printed or physical learning materials;
- Training aids;
- Promotional products;
- Apparel;
- Merchandise; and
- Other physical products made available from time to time.
Digital Products and Services
The digital products and services available through Level Flight may include, but are not limited to:
- E-learning courses;
- Ground school courses;
- Exam preparation products;
- Adaptive learning tools;
- Digital training resources;
- Downloadable or printable educational materials;
- Video, audio, written, and interactive course content;
- Practice exams, quizzes, and question banks;
- Software-supported learning tools;
- Course certificates, completion records, recommendation support, or related student support services; and
- Other aviation education resources.
Unless otherwise stated, digital products and services are paid for in full at the time they are ordered.
Product Information
These Terms apply to all goods, digital products, and services displayed on our Site at the time you access or purchase them, including products listed as unavailable, sold out, coming soon, discontinued, or out of stock.
We make reasonable efforts to ensure that product information, descriptions, images, availability, pricing, access periods, features, taxes, and fees are accurate and current. However, we do not guarantee that all information, descriptions, images, features, pricing, availability, or other product details will be complete, accurate, current, or error-free.
Images shown on our Site may be for illustration purposes only. Physical goods may vary slightly from images due to manufacturing, supplier, printing, sizing, display, or production differences.
Orders
By placing an order, you agree to provide complete, accurate, and current billing, shipping, contact, account, and payment information.
We reserve the right to modify, reject, or cancel an order where necessary, including where:
- A product or service is unavailable;
- There is a pricing, description, tax, shipping, or product error;
- We suspect fraud, abuse, account sharing, unauthorized resale, or other misuse;
- Payment is declined, reversed, disputed, or appears unauthorized;
- You have violated these Terms;
- We are unable to verify required information;
- A third-party provider, payment processor, supplier, or platform prevents fulfillment; or
- We are otherwise unable to fulfill the order.
If we cancel an order after payment has been processed, we will provide a refund equal to the amount paid for the cancelled order, unless the cancellation relates to fraud, misuse, chargeback abuse, account sharing, intellectual property infringement, unauthorized resale, or another circumstance where we are legally entitled to decline or limit a refund.
You are responsible for monitoring your payment instrument to confirm receipt of any refund.
14. Payments
We accept the following payment methods:
- Credit card; and
- Any payment method currently accepted through Stripe or our checkout provider.
When you provide payment information, you authorize Level Flight and our payment processors to charge the applicable amount to your selected payment method. You represent and warrant that you are authorized to use the payment method provided.
If we believe your payment has violated any law, payment processor rule, or these Terms, we may cancel or reverse the transaction, suspend access, refuse fulfillment, or take other appropriate action.
15. Taxes
Prices may be subject to applicable taxes. Unless otherwise stated, applicable taxes may be added at checkout based on the billing information, shipping information, product type, customer location, and applicable law.
You are responsible for providing accurate billing, shipping, tax, and location information.
16. Access to Digital Products and Services
Some Level Flight products and services are provided digitally or through an online account, learning platform, software tool, partner portal, or third-party service.
Unless otherwise stated in writing:
- Access begins on the date of purchase, registration, enrolment, or account activation;
- Access is limited to the access period stated on the product page, checkout page, receipt, course description, partner agreement, or other written communication from Level Flight;
- Access is for the registered user only and may not be shared, transferred, sold, or assigned;
- Expired access may require a new purchase, renewal, or extension;
- We are not required to provide indefinite access to any course, product, software feature, or material; and
- We may update, replace, remove, reorganize, or discontinue content or features from time to time.
- We may temporarily interrupt access for maintenance, updates, security, technical issues, platform changes, third-party service outages, or circumstances beyond our reasonable control.
17. Recommendations, Certificates, Completion Records, and Exam Support
Some Level Flight courses or products may include completion tracking, practice exams, recommendation support, certificates, study guidance, or other learning records.
Unless expressly stated otherwise:
- Completion of a Level Flight course does not guarantee a licence, permit, rating, examination pass, job, admission to a flight school, or approval by any regulator;
- A practice exam score does not guarantee performance on an official examination;
- Course completion records, certificates, or recommendations may be subject to additional requirements, review, processing time, academic integrity expectations, and verification;
- We may refuse, delay, revoke, or correct a certificate, recommendation, completion record, or support document if we believe the result is inaccurate, incomplete, improperly obtained, affected by account sharing, affected by academic misconduct, or otherwise unreliable; and
- You remain responsible for confirming and meeting all applicable regulatory, training, medical, licensing, examination, and flight school requirements.
18. Third-Party Platforms, Tools, Goods, and Services
Our Site, products, or services may include or rely on third-party platforms, integrations, payment processors, learning management systems, hosting providers, analytics tools, email services, video hosting, software tools, partner content, suppliers, shipping carriers, or links to third-party websites.
We do not own or control third-party websites, platforms, services, goods, suppliers, shipping carriers, or policies. We are not responsible for the content, security, availability, accuracy, terms, privacy practices, quality, or performance of any third-party website, platform, service, supplier, carrier, or provider.
Your use of third-party services may be subject to separate terms and privacy policies.
19. Marketing Communications
If you subscribe to our emails, purchase a product, create an account, request information, or otherwise provide contact information, we may send you transactional, administrative, service-related, and, where permitted, commercial electronic messages.
Commercial electronic messages will be sent in accordance with applicable Canadian anti-spam laws. Where required, we will obtain consent, identify ourselves, and provide an unsubscribe mechanism.
You may unsubscribe from marketing communications using the unsubscribe mechanism provided in the message or by contacting us at support@levelflight.ca. Even if you unsubscribe from marketing emails, we may still send transactional or service-related messages where permitted by law, such as purchase receipts, account notices, course access information, policy notices, security alerts, or support communications.
20. Privacy
Your privacy is important to us. Our collection, use, disclosure, retention, and protection of personal information is governed by our Privacy Policy and applicable privacy laws.
By using our Site, products, services, accounts, platforms, or support channels, you acknowledge that we may collect and use personal information as described in our Privacy Policy, including information needed to provide accounts, process payments, deliver courses, fulfill orders, ship goods, support users, track progress, maintain security, prevent account sharing, improve our services, and comply with legal obligations.
You are responsible for ensuring that the personal information you provide is accurate and current.
21. Security
We use reasonable administrative, technical, and organizational measures designed to protect our Site, systems, accounts, and personal information. However, no website, platform, software system, payment system, shipping system, or internet transmission is completely secure.
You are responsible for keeping your account credentials confidential and for promptly notifying us if you suspect unauthorized access, misuse, or a security issue involving your account.
22. Shipping and Delivery of Physical Goods
When you purchase physical goods from our Site, the goods will be delivered through one of the following methods:
- Standard delivery by post; or
- Any other delivery method made available at checkout.
Delivery will take place as soon as reasonably possible, depending on the delivery method selected, product availability, shipping destination, carrier availability, and other relevant circumstances. Delivery times are estimates only and may vary due to unforeseen circumstances. Delivery times do not include weekends or statutory holidays unless otherwise stated.
You will not be charged for delivery of physical goods purchased on our Site unless otherwise stated at checkout.
You are required to provide a complete and accurate delivery address, including the name of the recipient. We are not liable for delivery to the wrong address or wrong person as a result of inaccurate or incomplete information provided by you.
Risk of loss or damage to physical goods passes to you when the goods are delivered to the shipping address you provided, except where applicable law provides otherwise.
23. Refunds for Goods
Refund requests for goods must be made within 7 days after receipt of your goods.
We accept refund requests for goods sold on our Site for any of the following reasons:
- The good is broken;
- The good does not match the description;
- The good is the wrong size; or
- The good does not meet the purchaser’s expectations.
Refunds do not apply to the following goods:
- Goods that contain sealed packaging and have been opened.
To request a refund for goods, please contact us at support@levelflight.ca and include your order details, contact information, reason for the refund request, and any relevant photos or supporting information.
24. Refunds for Services and Digital Products
We provide refunds for services and digital products sold on our Site as follows:
- E-learning courses are eligible for a full refund within 14 days of the original purchase, provided that less than 50% of the course has been completed. A refund can be requested by emailing support@levelflight.ca or by using the contact form on our Site.
- The refund policy for courses purchased through flight school partnerships is the same as above, unless a separate written agreement says otherwise.
We may decline a refund, in whole or in part, where we reasonably believe there has been account sharing, unauthorized use, intellectual property misuse, fraud, chargeback abuse, violation of these Terms, excessive use inconsistent with a refund request, copying or downloading of protected materials, or other improper activity.
Nothing in this refund policy limits any non-waivable rights you may have under applicable consumer protection law.
25. Returns
Returns can be made by mail.
To return a good by mail, follow this procedure:
- Pack your goods securely.
- Write the return address as:

- Go to your nearest post office and pay the necessary postage.
Unless otherwise required by law or agreed by Level Flight in writing, you are responsible for return shipping costs. Original shipping costs will NOT be refunded.
26. Consumer Protection Law
Where the Consumer Protection Act, the Internet Sales Contract Regulation, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms will not limit your legal rights and remedies under that legislation.
These Terms will be read subject to the mandatory provisions of applicable consumer protection legislation. If there is a conflict between these Terms and mandatory consumer protection legislation, the mandatory provisions of that legislation will apply.
27. Accuracy of Information and No Guarantee of Results
We make reasonable efforts to provide accurate and useful educational materials, product descriptions, course information, pricing, and support. However, we do not guarantee that our Site, courses, materials, products, software, explanations, practice questions, exam prep tools, recommendations, goods, or other services will be complete, current, error-free, uninterrupted, secure, or suitable for your specific purpose.
We do not guarantee that use of our products or services will result in:
- Passing an examination;
- Obtaining a licence, permit, rating, endorsement, or recommendation;
- Meeting regulatory, flight school, or employer requirements;
- Achieving a specific grade or score;
- Completing training in a particular timeframe;
- Employment or career advancement; or
- Any specific aviation, educational, commercial, or operational outcome.
28. Availability, Changes, and Discontinuation
We may update, modify, suspend, discontinue, replace, or remove any part of our Site, products, services, courses, software features, content, goods, or materials at any time.
We may do this for reasons including:
- Content updates;
- Regulatory changes;
- Platform changes;
- Security;
- Business changes;
- Third-party service changes;
- Product improvements;
- Technical issues;
- Supplier changes;
- Shipping or fulfillment issues; or
- Discontinuation of a product or service.
Where reasonable, we will try to avoid materially reducing access to a paid digital product during the applicable access period, but we do not guarantee that any specific feature, lesson, format, layout, tool, or item of content will remain available indefinitely.
29. Suspension and Termination
We may limit, suspend, or terminate your account, access, licence, purchases, or use of our Site, products, services, software, community areas, or materials if we believe that:
- You have violated these Terms;
- You have shared account access;
- You have misused or copied Level Flight materials;
- You have engaged in fraud, abuse, harassment, or unlawful activity;
- Your payment is disputed, reversed, fraudulent, or unpaid;
- Your conduct creates legal, security, operational, reputational, or financial risk;
- We are required to do so by law, regulation, court order, payment processor, platform provider, or other authority; or
- Continuing to provide access would be harmful to Level Flight, our users, our partners, or any third party.
Suspension or termination does not limit any other rights or remedies available to us.
30. Chargebacks and Payment Disputes
If you believe there is an issue with a charge, product, refund, or purchase, you agree to contact us first so we can try to resolve the issue.
We may suspend or terminate access to products or services associated with a disputed, reversed, fraudulent, or unpaid transaction. We may also refuse future purchases where we reasonably believe there has been chargeback abuse, payment fraud, or misuse of our refund policy.
31. Links to Other Websites
Our Site may contain links to third-party websites or services that we do not own or control.
We are not responsible for the content, policies, practices, accuracy, security, or availability of any third-party website or service linked to on our Site. It is your responsibility to read the terms and privacy policies of third-party websites and services before using them.
32. Limitation of Liability
To the fullest extent permitted by applicable law, Level Flight Inc. and our directors, officers, employees, contractors, agents, affiliates, licensors, service providers, suppliers, shipping providers, and partners will not be liable for any indirect, incidental, consequential, special, aggravated, punitive, or exemplary damages, or for any loss of profits, revenue, business, opportunity, goodwill, data, use, training progress, examination results, or anticipated savings, arising out of or related to your use of, or inability to use, our Site, products, services, courses, software, materials, goods, or accounts.
To the fullest extent permitted by applicable law, our total liability for any claim arising out of or related to these Terms, the Site, or any product or service will be limited to the amount you paid to Level Flight for the specific product or service giving rise to the claim in the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability will be limited to the greatest extent permitted by law.
33. Indemnity
Except where prohibited by law, you agree to indemnify and hold harmless Level Flight Inc. and our directors, officers, employees, contractors, agents, affiliates, licensors, service providers, suppliers, shipping providers, and partners from and against any claims, demands, actions, losses, damages, liabilities, costs, and expenses, including reasonable legal fees, arising out of or related to:
- Your use of our Site, products, services, software, courses, accounts, materials, or goods;
- Your violation of these Terms;
- Your violation of applicable law;
